Terms of Service

These Terms of Service ("Terms") govern the relationship between Bluewater Brick Restoration ("Bluewater Brick," "we," "us," or "our") and the customer ("you" or "Client") with respect to all interlocking brick installation, paver restoration, power washing, sealing, and related masonry services performed at your property. By accepting a written estimate or authorizing work to proceed, you agree to be bound by these Terms.
1. Estimates and Service Agreements
All work is performed pursuant to a written estimate or proposal provided to the Client prior to commencement. Estimates are valid for thirty (30) days from the date of issue. An estimate becomes a binding service agreement upon the Client's written or verbal authorization to proceed, or upon receipt of a deposit where required.
Scope of work is as described in the estimate. Any changes to the scope — including additions, deletions, or material substitutions — must be agreed upon in writing before work proceeds. Additional work beyond the original scope will be quoted and invoiced separately.
Bluewater Brick reserves the right to decline any project or withdraw an estimate prior to commencement without obligation.
2. Payment Terms
Unless otherwise specified in writing, the following payment terms apply:
- —Deposit: A deposit of up to 50% of the total project value may be required prior to scheduling or ordering materials. Deposits are non-refundable if the Client cancels after materials have been ordered or work has been scheduled.
- —Balance due: The remaining balance is due upon completion of work, prior to the crew leaving the site, unless alternative payment terms have been agreed to in writing.
- —Accepted payment methods: Cash, cheque, e-Transfer, and major credit cards. A processing fee may apply to credit card payments.
Invoices not paid within fifteen (15) days of the due date are subject to a late payment charge of 2% per month (24% per annum) on the outstanding balance, compounded monthly.
In the event that collection action is required, the Client agrees to reimburse Bluewater Brick for all reasonable costs of collection, including legal fees on a substantial indemnity basis.
3. Scheduling, Access, and Site Conditions
The Client agrees to provide safe, unobstructed access to the work area on the scheduled date. This includes moving vehicles, patio furniture, planters, and any personal property from the work zone prior to crew arrival. Bluewater Brick is not responsible for damage to items left in the work area.
Work may be rescheduled due to inclement weather, unsafe site conditions, or other circumstances beyond our control. We will provide reasonable notice of rescheduling and will not be liable for delays caused by weather or conditions outside our reasonable control.
The Client is responsible for ensuring that underground utilities, irrigation lines, and drainage infrastructure are clearly marked before work begins. Bluewater Brick will not be liable for damage to unmarked or improperly marked utilities. Clients are encouraged to contact Ontario One Call (1-800-400-2255) prior to any excavation work.
4. Warranty
Bluewater Brick warrants its workmanship against defects in labour for a period of two (2) years from the date of project completion, subject to the exclusions below. Where a manufacturer's warranty applies to materials supplied by Bluewater Brick, that warranty is passed through to the Client to the extent permitted.
The workmanship warranty does not cover:
- —Damage caused by frost heave, subsidence, or ground movement beyond normal tolerances for the region
- —Damage resulting from improper use, vehicular traffic on areas not designed for it, or abuse
- —Damage caused by tree roots, soil erosion, or pre-existing drainage deficiencies not addressed in the original scope of work
- —Normal weathering, fading, efflorescence, or colour variation in natural stone and brick products
- —Work performed on structures with pre-existing structural deficiencies not disclosed at the time of estimate
- —Power washing services — results depend on the condition and age of surfaces and are not warrantied against staining or organic regrowth
Warranty claims must be submitted in writing within the warranty period. Bluewater Brick's sole obligation under this warranty is to repair or re-perform the deficient work at our cost. We do not provide cash refunds under warranty.
5. Limitation of Liability
To the fullest extent permitted by applicable Ontario law, Bluewater Brick's total liability to the Client for any claim arising out of or related to services performed shall not exceed the total amount paid by the Client for the specific work giving rise to the claim.
Bluewater Brick shall not be liable for any indirect, incidental, consequential, or special damages, including loss of use, loss of revenue, or cost of temporary repairs, regardless of whether such damages were foreseeable.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
6. Insurance
Bluewater Brick carries general commercial liability insurance and WSIB coverage as required by Ontario law. A certificate of insurance is available upon written request. The Client is encouraged to maintain their own property and homeowner's insurance throughout the project.
7. Cancellation
The Client may cancel a scheduled project by providing at least five (5) business days' written notice prior to the start date without penalty, provided no materials have been ordered. Cancellations with less than five (5) business days' notice, or after materials have been ordered, may result in forfeiture of the deposit and/or a restocking or cancellation fee to cover direct costs incurred.
8. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful within thirty (30) days, either party may pursue remedies available under Ontario law.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be conducted in the courts of Ontario.
9. General
These Terms constitute the entire agreement between the parties with respect to the services described herein and supersede all prior negotiations, representations, or agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Bluewater Brick reserves the right to update these Terms at any time. The version in effect at the time services are authorized governs that engagement.
